Amendments to the Swan and Canning Rivers Management Act 2006 and Swan and Canning Rivers Management Regulations 2007 came into effect on 1 July 2015.


Key changes

  • The Swan Canning River Reserve remains vested with the Swan River Trust, but the waterway is managed on its behalf by the Department of Parks and Wildlife.

  • The statutory functions of the Swan and Canning Rivers Management Act 2006 remain essentially unchanged but are divided between the Swan River Trust Board and the Director General of Parks and Wildlife.


The Swan River Trust has the following functions:

  • Developing policies for the protection and enhancement of the Development Control Area (DCA), the Riverpark and the Riverpark shoreline

  • Establishing targets for ecological and community benefits and the amenity of the Riverpark and mechanisms for achieving those

  • Preparing and dealing with strategic documents

  • Advising the Director General on development matters

  • Advising the Director General on promoting the activities of other bodies having functions in the catchment affecting the Riverpark

  • Reporting to the Minister on the state of the DCA and development on and adjoining the DCA

  • Providing advice to planning authorities so that proper provision can be made in planning schemes for reservation of land etc

  • Providing advice and promoting public education on any matter within its functions

  • Providing advice to the Western Australian Planning Commission (WAPC) on development abutting, partially in, or affecting the DCA


The Director General has the following functions:

  • Responsibility for protecting and enhancing the ecological and community benefit and amenity of the Riverpark

  • Carrying out works/facilities for that purpose

  • Management of the River Reserve and Riverpark shoreline

  • Managing leases and licences for the River Reserve

  • Issuing permits and licences

  • Issuing River Protection Notices

  • Monitoring the state of the DCA and development within and adjoining it

  • Providing assistance to planning authorities on various matters

  • Providing advice to the WAPC on policies, planning schemes etc

  • Entering into collaborative arrangements

  • Financial and audit accountabilities and reporting

Planning and development

Amendments to the Swan and Canning Rivers Management Act 2006 have changed planning approval and assessment processes for development proposals.
